This is a rather important case, since it establishes new precedents and defines individual responsibilities.

In future, JW elders will not be able to depend on “clergy privilege” and so will not be allowed to cover up information about child abuse revealed in so-called “penitential confessions”.

People in professional positions, such as clergy, police officers, doctors and teachers are sometimes charged with particular legal responsibility to report cases of abuse, and can be fined if they fail to do so, but it is now being said that in the State of Delaware this code enforcement is not limited to these professions. In fact, every Delaware citizen is expected to report, regardless of their occupation.

Another principle being emphasised is that if you discover evidence of child abuse you should not report it first to church leaders or to the accused. Your immediate port of call should be the civil authorities: the police or the social services. Otherwise the perpetrators may be forewarned and have time to destroy evidence, intimidate witnesses or go into hiding.

Now that these precedents have been set, leaders of several other churches may be faced with criminal prosecutions for their failure to report child abuse. Up till now there have been almost no such prosecutions anywhere.

That ought to rattle a few chains in the EB...there’s been allegations of abuse in the EB for decades that apparently were never reported to the authorities..all it would take to blow the lid off would be one victim going to the police....nope the ‘assembly’ isn’t the place to deal with it-if they dealt with it all( I suspect any allegation of child abuse might be ‘covered’if the alleged perpetrator was a high ranking member) I also suspect the prospect of a public interrogation at a ‘care meeting’ was enough to intimidate victims into silence....all this created the perfect venue for perpetrators to act with impunity,knowing the chances of them being exposed were slim
